This situation isn’t uncommon. I’ve seen many families face serious problems when someone passes away without a will, trust, or even a power of attorney. I’ve seen it in my own family, too. A relative of mine had a lot of homes and properties, but he passed away without a will. Even though he had people who loved and cared for him, some of his properties ended up being sold for unpaid taxes- pennies on the dollar to strangers taking advantage of the situation. The people he wanted to help were left with nothing, all because he didn’t have the right legal documents prepared before he died.

The lesson here is clear: it doesn’t matter if you’ve verbally told someone they’ll get your property after you pass—without a legal will or trust, your wishes may not be followed. Your family could lose the money or property they need to support themselves, and it could end up in the hands of someone else.  Worse, it could cause family fights and hard feelings and result in injustice to your loved ones.
